  • The "Nature" Disclaimer: Gardening involves living organisms and natural ecosystems. We cannot guarantee that plants will survive, yield specific quantities of produce, or look exactly as envisioned, as success depends heavily on weather, soil conditions, pests, and your ongoing maintenance.

  • No General Contractor Liability: Our designs and plant lists are for conceptual and informational purposes. We are not structural engineers, landscape architects, or general contractors. Any physical digging, construction, or structural modifications are your responsibility to execute safely or hire out to licensed professionals.

3. Consultation Booking, Payments, & Cancellations

  • Fees: Fees for consultations and design packages are disclosed at the time of booking and are due [e.g., upfront / upon receipt of invoice].

  • Cancellations & Rescheduling: We require at least [e.g., 24 or 48] hours' notice to cancel or reschedule a consultation. Cancellations made with less notice may forfeit the booking fee.

4. Property Access & Safety (For In-Person Visits)

If your consultation involves an on-site visit:

  • You agree to grant us safe access to the designated outdoor areas of your property at the scheduled time.

  • You must secure any pets and notify us of any known property hazards (e.g., aggressive animals, hidden holes, exposed wiring, or aggressive hornets/wasps) prior to our arrival.

5. Intellectual Property

All custom garden designs, planting schedules, guides, and digital materials provided to you are the intellectual property of [Your Business Name].

  • You are granted a single-use license to use these materials for your personal property.

  • You may not resell, redistribute, or use our custom designs for commercial purposes without our express written consent.

6. Limitation of Liability

Terms & Conditions - the basics

Having said that, Terms and Conditions (“T&C”) are a set of legally binding terms defined by you, as the owner of this website. The T&C set forth the legal boundaries governing the activities of the website visitors, or your customers, while they visit or engage with this website. The T&C are meant to establish the legal relationship between the site visitors and you as the website owner. 

 

T&C should be defined according to the specific needs and nature of each website. For example, a website offering products to customers in e-commerce transactions requires T&C that are different from the T&C of a website only providing information (like a blog, a landing page, and so on).     

 

T&C provide you as the website owner the ability to protect yourself from potential legal exposure, but this may differ from jurisdiction to jurisdiction, so make sure to receive local legal advice if you are trying to protect yourself from legal exposure.

What to include in the T&C document
